The Telekom Austria Group informs that the Austrian Federal Competition Authority and the Federal Cartel Attorney have publicly announced today that they will not file an appeal against the decision of the Austrian Cartel Court to approve the acquisition of YESSS! Telekommunikation GmbH by Telekom Austria AG. Further, Telekom Austria Group has been informed by the Cartel Court that both, the FCA and theFederal Cartel Attorney, have submitted a formal waiver to file an appeal.
The FCA and the Federal Cartel Attorney had the possibility to appeal against the decision of the Cartel Court within four weeks after the decision was served, ie until 27 December 2012. Since the approval becomes legally binding, a major condition for the closing of the transaction is fulfilled.
